1. Who we are
AirFlow Performance (the "Service") is operated by:

In these Terms of Service (the "Terms") we refer to MBAM sp. z o.o. as "we", "us", "our" or the "Provider", and to you as the "User" or "you".
2. About these Terms
These Terms govern your access to and use of the AirFlow Performance mobile application (iOS and Android), the onboarding and account website at app.airflowperformance.pl, and all related features (together, the "Service").
By creating an account, completing onboarding, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
3. Definitions
- Player — an athlete with an active subscription, assigned to one Coach, who records BOLT measurements and (optionally) connects health data.
- Coach — a user who supervises one or more Players, reviews their readiness data, shares files and messages.
- BOLT score — a Body Oxygen Level Test result measured manually within the app.
- Whoop data — optional physiological metrics imported from a User's Whoop account (e.g. heart-rate variability, sleep, resting heart rate, respiratory rate).
- Subscription — the paid, recurring plan that grants access to the Service.
4. Eligibility and accounts
4.1 Age. The Service is available to athletes of any age. Where a User is under 18, use of the Service and the processing of their data take place with the involvement and consent of a parent or legal guardian, obtained in connection with the coaching relationship, as described in the Privacy Policy. The parent or legal guardian is responsible for accepting these Terms on the minor's behalf.
4.2 Registration. Access is granted by invitation (magic link sent by e-mail). You must provide accurate information (first name, last name, date of birth and, where applicable, your club) and keep it up to date.
4.3 Account security. You are responsible for keeping your password and account credentials confidential and for all activity under your account. Notify us promptly at info@airflowperformance.pl if you suspect unauthorised use.
4.4 One account per person. Accounts are personal and may not be shared or transferred.
5. Roles and relationships
5.1 The Service supports two roles — Player and Coach. Your role is assigned during onboarding or by your organisation/Coach.
5.2 A Player is linked to a single Coach. A Coach can view the readiness data, profile information, BOLT history and (where connected) health summaries of the Players assigned to them, exchange chat messages, share files and pin notes. By using the Service as a Player, you acknowledge that this information is visible to your assigned Coach.
6. Subscriptions, pricing and payment
6.1 Paid Service. Access to the Service requires an active Subscription. Payment is processed exclusively through our payment provider Stripe on the website; payments are not taken inside the mobile app.
6.2 Price. The applicable price, billing interval (e.g. monthly) and currency are displayed at checkout before you confirm payment. Prices may change from time to time; any change applies to billing periods starting after the change and is shown at checkout.
6.3 Recurring billing / auto-renewal. Unless stated otherwise at checkout, the Subscription renews automatically at the end of each billing period at the then-current price, until cancelled. By subscribing you authorise us (via Stripe) to charge the recurring fee.
6.4 No free trial is offered unless explicitly stated at checkout.
6.5 Taxes. Prices include or exclude applicable taxes (VAT) as indicated at checkout.
6.6 Failed payments. If a renewal payment fails, we may suspend or terminate access to the Service until payment is resolved.
7. Right of withdrawal (consumers)
7.1 If you are a consumer in the European Union, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, in accordance with the Polish Consumer Rights Act (ustawa o prawach konsumenta) implementing Directive 2011/83/EU.
7.2 Digital services exception. Where the Service is a digital service supplied immediately, you may expressly request that performance begins before the withdrawal period ends and acknowledge that, by doing so, you lose the right of withdrawal once the service has been fully performed. Where performance has begun but is not complete, you may be charged proportionally for what was provided.

8. Cancellation and termination
8.1 By you. You may cancel your Subscription at any time; cancellation takes effect at the end of the current billing period and you retain access until then. No partial refunds are given for unused time unless required by law.
8.2 Account deletion. You can delete your account from within the app (Settings → Delete account). Deletion permanently removes your profile and associated data as described in the Privacy Policy and cannot be undone.
8.3 By us. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law, with notice where reasonably practicable.
9. Health, fitness and medical disclaimer
9.1 Not medical advice. The Service provides wellness and training-related information (including BOLT scores, readiness indicators and, where connected, Whoop metrics). It is not a medical device and does not provide medical advice, diagnosis or treatment. Readiness indicators (e.g. green/amber/red) are training-support signals only.
9.2 Consult a professional. Always consult a qualified physician or healthcare professional before starting, changing or stopping any training or breathing programme, and if you have any medical condition or concern. Never disregard professional medical advice because of something you saw in the Service.
9.3 Your responsibility. You use the Service and follow any training guidance at your own risk. We are not responsible for injuries, health outcomes or decisions made on the basis of information shown in the Service.
10. Third-party services and integrations
10.1 The Service relies on third parties, including: Stripe (payments), Supabase (database, authentication, storage), Google Firebase Cloud Messaging (push notifications), Whoop (optional health-data integration), Resend (transactional e-mail), and a football-data API (TheSportsDB) used for club/team look-ups. Your use of these integrations may be subject to the third party's own terms.
10.2 Whoop. Connecting Whoop is optional and initiated by you. You may disconnect Whoop at any time in the app; historical data already imported is retained as described in the Privacy Policy unless you delete your account.
10.3 App stores. Downloads via the Apple App Store and Google Play are subject to those stores' terms.
11. Acceptable use
You agree not to: (a) use the Service unlawfully or for any unlawful purpose; (b) attempt to gain unauthorised access to the Service or other users' data; (c) interfere with or disrupt the Service or its security (including row-level security and access controls); (d) reverse engineer, scrape or copy the Service except as permitted by law; (e) upload content that is illegal, harmful, infringing or that you have no right to share; or (f) impersonate any person or entity.
12. User content
12.1 You retain ownership of content you submit (e.g. chat messages, shared files, BOLT entries, profile data). You grant us a limited licence to host, process and display that content solely to operate and provide the Service.
12.2 You are responsible for the content you upload and confirm you have the rights to share it. We may remove content that violates these Terms or applicable law.
13. Intellectual property
The Service, including its software, design, trademarks, logos and content (excluding User content), is owned by or licensed to MBAM sp. z o.o. and is protected by intellectual-property laws. No rights are granted to you except the limited right to use the Service under these Terms.
14. Availability and changes to the Service
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, with reasonable notice where the change materially and adversely affects paying Users.
15. Limitation of liability
15.1 Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, or for intentional misconduct).
15.2 To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of data, profits or health outcomes arising from your use of, or inability to use, the Service. Our total aggregate liability for any claim relating to the Service is limited to the amounts you paid to us for the Subscription in the 12 months preceding the event giving rise to the claim.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes (e.g. by e-mail or in-app) before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
17. Governing law and disputes
17.1 These Terms are governed by Polish law, without prejudice to mandatory consumer-protection rules of the country where a consumer User resides.
17.2 Consumers may use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr and may have access to out-of-court dispute-resolution bodies.
17.3 Subject to mandatory law, disputes shall be submitted to the courts competent for the registered seat of the Provider.
